Terms of Service – Swissli

1. Introduction
These Terms of Service ("Terms") govern your use of the Swissli mobile application ("App"), operated by an independent developer based in Switzerland ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the App.
2. Description of the Service
Swissli is a mobile application designed to help users learn Swiss German dialects through structured lessons and educational content.
We may update, modify, or discontinue features of the App at any time.
3. User Accounts
To use certain features of the App, you must create an account.
You may create an account by:
- registering with your email address, or
- signing in via third-party providers such as Google or Apple.
You are responsible for:
- maintaining the confidentiality of your account
- all activity that occurs under your account
You agree to provide accurate and complete information when creating an account.
4. Subscriptions and Payments
Some features of Swissli require a paid subscription.
Subscriptions are processed through:
- Apple App Store
- Google Play Store
Payments are handled directly by Apple or Google. We do not store payment card information.
Subscription management and validation are handled via RevenueCat.
Subscription terms:
- Subscription length, price, and renewal terms are displayed in the App at the time of purchase.
- Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the period ends.
- Cancellation takes effect at the end of the current billing period.
- Manage or cancel: iOS — Settings → [Your Name] → Subscriptions; Android — Google Play → Subscriptions.
- Refunds are handled by Apple or Google per their respective policies. We do not process refunds directly.
iOS users: the App is licensed, not sold, and your use is also governed by Apple's standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In case of conflict, our Terms prevail except where Apple's EULA is mandatory under App Store rules.
5. EU Consumer Right of Withdrawal
If you are a consumer in the European Union or European Economic Area, you have a 14-day right to withdraw from digital content purchases under Directive 2011/83/EU (Consumer Rights Directive).
Waiver of withdrawal right: By purchasing a subscription and accessing the App's premium content immediately, you expressly consent to the immediate performance of the contract and acknowledge that you lose the right of withdrawal once performance has begun, as permitted under Article 16(m) of Directive 2011/83/EU.
If you have not yet accessed premium content, you may withdraw within 14 days by contacting us at swissli.support@gmail.com. Refunds for App Store and Google Play purchases are processed by Apple and Google respectively according to their store policies.
6. Acceptable Use
You agree not to:
- misuse the App
- attempt to gain unauthorized access to systems
- reverse engineer or decompile the App
- use the App for illegal purposes
- interfere with the operation of the App
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Intellectual Property
All content within the App, including but not limited to:
- lessons
- text
- audio
- design
- branding
is the intellectual property of Swissli or its licensors.
You may not reproduce, distribute, or create derivative works without permission.
8. Educational Purpose Disclaimer
Swissli provides educational content for language learning purposes.
We do not guarantee:
- language proficiency
- learning outcomes
- accuracy of dialect usage in all regional contexts
9. Termination
We may suspend or terminate your access to the App if you:
- violate these Terms
- misuse the service
- engage in fraudulent activity
You may stop using the App at any time.
You may request account deletion by contacting us.
10. Limitation of Liability
To the maximum extent permitted by law, Swissli and its operator shall not be liable for:
- indirect or consequential damages
- loss of data
- loss of profits
- service interruptions
- technical errors
The App is provided "as is" without warranties of any kind, except those that cannot be excluded under applicable law.
Nothing in these Terms limits liability for gross negligence, intentional misconduct, or personal injury caused by our acts (Art. 100 Swiss Code of Obligations), nor does it affect mandatory consumer protections under the law of your country of habitual residence.
11. Service Availability
We strive to keep the App available and functioning properly, but we do not guarantee uninterrupted access.
Maintenance, updates, or technical issues may temporarily affect availability.
12. Changes to the Terms
We may update these Terms from time to time.
If significant changes occur, users may be notified within the App.
Continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Switzerland, excluding the conflict of law rules and the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer in the European Union, you retain the protection of mandatory provisions of the law of your country of habitual residence (Art. 6 Rome I Regulation).
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution before a consumer arbitration board.
Place of jurisdiction for all disputes is the competent court at the operator's seat in Switzerland, subject to mandatory consumer jurisdiction rules.
